Basis: Article 6 of the Child Care Support Act (Grounds for Disqualification)
Verification target: Those who wish to work as child caretakers (those eligible for new and renewed contracts)
Verification procedure (confirmation of reasons for disqualification is the authority of the city/county/district head)
Disqualification for child care (Article 6 of the Child Care Support Act)
1. Minor, adult guardian, limited guardian
2. Mentally ill people
3. Addicted to drugs, marijuana or psychotropic drugs
4. A person who has been declared bankrupt and has not been reinstated.
5. A person who was sentenced to imprisonment without prison labor or heavier punishment and for whom three years have not passed since the execution was completed (including cases where the execution is deemed to have been completed) or the execution was exempted.
6. A person who has been sentenced to probation of imprisonment or heavier punishment and is currently in the probation period.
7. Violation of Article 17 of the Child Welfare Act, a crime under Article 71 (1) of the same Act, a sexual violence crime under Article 2 of the Special Act on the Punishment of Sexual Violence Crimes, or Article 2 of the Act on Sexual Protection of Children and Adolescents. A person who was sentenced to punishment or medical treatment and custody for committing a sex crime against children or juveniles pursuant to Article 2, and for whom 10 years have not passed since the date on which all or part of the sentence or medical treatment and custody was completed or the execution was suspended or exempted.
7-2. A person who was sentenced to imprisonment or heavier punishment for a crime related to child abuse pursuant to Article 3, Paragraph 7-2 of the Child Welfare Act, and for whom 20 years have not passed since the date of completion or exemption of execution of the sentence.
7-3. A person who was sentenced to a suspended sentence of imprisonment or heavier punishment for a child abuse-related crime under Article 3, Paragraph 7-2 of the Child Welfare Act, and for whom 20 years have not passed since the date on which the suspended sentence was confirmed.
7-4. A person for whom 10 years have not passed since the date on which a fine was confirmed for a child abuse-related crime under Article 3, Paragraph 7-2 of the Child Welfare Act.
8. A person whose qualifications are suspended pursuant to Article 32
9. A person for whom less than two years have passed since his/her qualification was revoked pursuant to Article 33.
